Case-Fixing Roulette

When you're controlling the ball, the compulsion is irresistible, but getting away with it is a gamble.

The Honorable Jim Letten
United States Attorney
Eastern District of Louisiana
501 Magazine Street
New Orleans, LA 70130

Dear Mr. Letten:

I find it ironic that the government's investigation of corruption at the Gretna courthouse
is being tried in the courtroom of Judge Ginger Berrigan as she herself was involved in case
fixing far more serious than that leveled against Ronald Bodenheimer.

In brief, Judge Berrigan first perjured herself by repeatedly failing to disclose that she
worked for a defendant (Tulane University) as an instructor, then she accepted a cash payment at
the same time she was adjudicating a case brought against it. Even Chief Judge Carolyn Dineen
King (see enclosure) thought this conduct was improper.

Clearly, Judge Berrigan lacks the moral authority to judge the honesty and integrity of
others. No wonder the public is so cynical about the American system of justice.

                                                                             Yours truly,

                                                                       s/ Carl Bernofsky

                                                                             Carl Bernofsky
                                                                             (504) 486-4639

Enc: Opinion, US Court of Appeals for the Fifth Circuit, Case No. 00-30704, filed
April 10, 2001: Carl Bernofsky v. Administrators of the Tulane Educational Fund,
Appeal from the US District Court for the Eastern District of Louisiana (USDC
